Damage analyses are sometimes viewed, to borrow a phrase, as voodoo economics; accountants and other economic damage experts run figures through their mystical black box, and out comes damage analyses. However, in reality, any reasonable damage analyses will be based upon facts and a rigorous testing of the facts and assumptions that are made. Additionally, a reasonable analysis should be based upon a solid understanding of generally accepted damage theories. This presentation addresses the methodologies and approaches generally applied in employment discrimination matters, as well as discusses the types of information that typically underpin the analyses. This presentation draws on the work that Baker Tilly FLVS professionals have performed as testifying experts in matters that have gone to verdict, including in Federal Court in the Western District of PA.
