Many think that employment lawyers only handle litigation. But we do so much more than file lawsuits and go to courthouses.
All I do is employment law across New York State. And a big part of my days are invested in speaking with employees and employers. My best clients have cases or claims that I call "sleepers." Those are the cases where the employee was still employed at the time I got the first call. Regardless of what side called me, gathering facts while an employee is still on payroll is incredibly valuable. Those are the truly great cases from either side. Discovery can begin while the employee is still at work instead of having to wait for an administrative agency to determine what documents or records are necessary or for discovery to begin after a lawsuit is filed.
Gathering evidence in litigation is great. But it costs a lot of money and takes a lot of time. The smart employees, and even small employers, begin preparing well before the courthouse steps. And they often get the best results with the least amount of stress, sometimes referred to as brain damage.
In 2018 I began making videos to explain some of the issues which come up regularly. I call my YouTube channel Employment Law Reality Check. I get comments on those videos. Employees, employers, and even lawyers comment on them. The lawyers are ones who themselves no longer take employment law claims. They got tired of telling employees that most of what they do to employees is not illegal, especially if it has no direct impact on the employee. The fact that an employer fails to pay income taxes will not help discriminated employees unless those employees' own taxes and deductions were improper or illegal.
We might think a situation is wrong or wrongful. But there is no remedy unless it was illegal or broke some contract. A wrongful termination is not necessarily an illegal one.
